ZASH is a cryptocurrency market information and alert service. The Service is provided by ZASH APP LTD, trading as ZASH, a company registered in England and Wales under company number 16987818. Support email: Support@zash.xyz. Website: https://zash.xyz.

In these Terms, "ZASH", "we", "us" and "our" refer to the legal entity identified above.

ZASH provides informational tools that may include:

• Cryptocurrency price alerts
• Market movement alerts
• Volume, volatility and momentum alerts
• Funding rate information
• Open interest information
• Liquidation information
• Wallet and blockchain activity information
• Prediction market information
• Custom alerts selected by users
• General cryptocurrency market data
• Telegram notifications
• Free and Premium features
• Other analytical or informational tools introduced from time to time

The availability and exact functionality of each feature may depend on the user's subscription plan, location, device, third-party data providers and technical availability.

ZASH does not operate a cryptocurrency exchange and does not execute trades on behalf of users. Unless expressly stated otherwise in a separate written agreement, ZASH does not:

• Hold or safeguard user funds
• Hold cryptocurrency for users
• Control user wallets
• Place trades for users
• Act as a broker or dealer
• Provide portfolio management
• Provide personalised investment advice
• Guarantee the execution of any transaction
• Guarantee any financial result

All information, alerts, notifications, charts, indicators, statistics, market data and other content provided through ZASH are supplied for general informational and educational purposes only. Nothing provided by ZASH constitutes:

• Financial advice
• Investment advice
• Trading advice
• Tax advice
• Legal advice
• An offer to buy or sell an asset
• A recommendation or endorsement of any cryptocurrency
• A guarantee that an asset will increase or decrease in value
• A personalised assessment of whether a trade is suitable for you

ZASH does not consider your personal financial circumstances, investment objectives, experience, risk tolerance or ability to sustain losses. You are solely responsible for conducting your own research and obtaining independent professional advice before making any financial, investment or trading decision.

Cryptocurrency and digital asset markets are highly volatile, speculative and risky. Prices may rise or fall substantially within a short period. You may lose some or all of the money used for cryptocurrency trading or investment. By using ZASH, you acknowledge that:

• Past performance does not guarantee future results
• Market data may be delayed, incomplete or inaccurate
• Alerts may be generated after a market movement has already occurred
• An alert does not guarantee a profitable trading opportunity
• Market conditions may change before you act on an alert
• Liquidity, slippage, fees and execution delays may affect results
• Leverage may significantly increase both profits and losses
• Exchanges, wallets, networks and third-party platforms may fail
• Cryptocurrency transactions may be irreversible
• Regulatory changes may affect access to cryptocurrency products
• ZASH cannot predict future market movements

You must never trade or invest money that you cannot afford to lose.

You must be at least 18 years old, or the minimum legal age required to enter into a binding contract in your country, to use the Service. By using ZASH, you confirm that:

• You have the legal capacity to agree to these Terms
• Your use of the Service is lawful in your jurisdiction
• You are not prohibited from receiving the Service
• You will comply with all laws and regulations applicable to you
• You will not use the Service for unlawful, fraudulent or abusive purposes

We may restrict or refuse access to the Service in certain countries or territories.

Certain features may require you to:

• Create an account
• Verify your email address
• Start or interact with the ZASH Telegram bot
• Link your Telegram account
• Provide a Telegram user ID or username
• Complete a payment
• Select alert preferences

You are responsible for maintaining the confidentiality and security of your account, email address, Telegram account, device and login credentials. You must notify us promptly if you believe that your account has been accessed without authorisation. You are responsible for activity carried out through your account unless the activity occurred because of a security failure directly attributable to ZASH.

You must not:

• Share a Premium account with unauthorised users
• Resell access to ZASH without written permission
• Allow others to use your account commercially
• Create accounts using false or misleading information
• Attempt to avoid subscription restrictions
• Use automated account creation methods
• Impersonate another person or organisation

ZASH may offer both free and paid Premium features. Free features may be limited by:

• Number of alerts
• Alert frequency
• Available cryptocurrency pairs
• Data history
• Customisation options
• Delivery speed
• Telegram functionality
• Access to advanced analytics

Premium plans may provide additional features as described on the relevant pricing or checkout page. We may modify the features included in free or Premium plans. Material changes affecting an active paid subscription will be communicated where reasonably practicable.

Unless expressly guaranteed in writing, purchasing a Premium plan does not guarantee:

• Any particular number of alerts
• Any profitable opportunity
• Any trading result
• Continuous market activity
• Continuous access to a particular data source
• That every cryptocurrency will be monitored
• That every relevant market event will be detected

ZASH may offer free trials, promotional plans, discount codes or limited-time access. The duration and conditions of a trial or promotion will be stated when it is offered. Unless otherwise stated:

• A user may use only one free trial
• Trials may be restricted by account, email, Telegram account, payment method, device or other reasonable identifiers
• Attempts to obtain repeated trials may result in suspension
• Promotional access may be changed or withdrawn where permitted by law
• Trial features may differ from paid Premium features

Where a free trial automatically becomes a paid subscription, the price, billing frequency and cancellation method will be shown before the user confirms the subscription.

Prices for Premium services will be displayed before purchase. Prices may be stated in pounds sterling, United States dollars, euros, cryptocurrency, Telegram Stars or another supported payment method. You are responsible for reviewing:

• The price
• The billing period
• Whether the payment is one-time or recurring
• Applicable taxes
• Payment processing fees
• Cryptocurrency network fees
• Currency conversion charges
• The features included in the selected plan

Payments may be processed by third-party payment providers. ZASH does not necessarily receive or store your complete payment card information. Payment information may be collected and processed directly by the applicable payment provider under its own terms and privacy policy. You authorise ZASH and its payment providers to charge the selected payment method for purchases you approve. You are responsible for providing accurate billing information.

Where a Premium plan is described as recurring, it will renew automatically at the stated billing interval until cancelled. By purchasing a recurring subscription, you authorise the applicable recurring charges. You may cancel a recurring subscription using the cancellation method displayed in your account, payment platform, Telegram interface or by contacting us at Support@zash.xyz.

Cancellation stops future renewals. Unless otherwise required by law, cancellation does not normally produce a refund for a billing period that has already started. Access may continue until the end of the paid billing period.

Deleting the Telegram bot conversation, blocking the bot or stopping the bot does not necessarily cancel an active subscription. The subscription must be cancelled through the applicable billing or payment method.

Your statutory consumer rights are not affected by these Terms. Customers may have cancellation or refund rights under the laws applicable to them, including rights relating to online contracts and digital services. Where required by law, we will provide information about:

• The applicable cancellation period
• How to exercise a cancellation right
• When access to a service begins
• Whether requesting immediate access affects cancellation rights
• Any amount payable for services supplied before cancellation
• How refunds are processed

Unless required by applicable law or expressly stated at checkout, payments are non-refundable after the relevant Premium service has been provided or made available. We may provide a full or partial refund at our discretion where:

• A duplicate payment was made
• A payment was taken after a valid cancellation
• A serious technical failure prevented access for a substantial period
• The wrong subscription was charged because of an error attributable to ZASH
• A refund is required by law

Refund requests must be submitted to Support@zash.xyz with sufficient payment and account information to identify the transaction. Cryptocurrency, network and third-party processing fees may be non-refundable where they have already been incurred and where permitted by law. Telegram Stars purchases may also be subject to Telegram's applicable payment and refund rules.

ZASH may obtain market information from cryptocurrency exchanges, blockchain networks, APIs, aggregators, public sources and other third parties. Although we aim to provide useful and timely information, we do not guarantee that any information is accurate, complete, current, error-free, delivered in real time, suitable for a specific purpose, or consistent with data displayed on another platform.

Different exchanges and data providers may display different prices, volumes, funding rates, open interest figures or other market information. Data may be delayed or affected by:

• API limitations
• Network congestion
• Exchange outages
• Rate limits
• Maintenance
• Incorrect third-party data
• Software errors
• Internet or Telegram delivery delays
• Blockchain reorganisations or delays
• Events beyond our reasonable control

You should independently verify important information before taking any action.

Alerts are generated using settings, thresholds, formulas, algorithms, market data and third-party information. An alert indicates only that specified conditions may have been detected. It does not mean that:

• A trade should be entered
• A trade will be profitable
• The market will continue moving in the same direction
• The data is free from error
• The alert will arrive before other market participants act
• The alert is appropriate for your circumstances

We do not guarantee that every qualifying event will generate an alert or that every generated alert will be delivered successfully. You are responsible for checking your notification, Telegram, device, internet and account settings.

The Service may contain links to, integrate with or rely upon third-party services, including Telegram, cryptocurrency exchanges, blockchain networks, payment providers, analytics providers, hosting providers, email providers, social media platforms, and data and API providers.

Third-party services are not controlled by ZASH and may be subject to separate terms, fees, policies and risks. ZASH is not responsible for the availability, security, accuracy, actions, omissions or performance of third-party services, except to the extent that responsibility cannot lawfully be excluded. A link or integration does not necessarily constitute an endorsement.

ZASH may use referral or affiliate links. Where applicable, ZASH may receive a commission, referral fee or other benefit when a user registers with or uses a third-party service through such a link. The existence of an affiliate relationship does not change your responsibility to independently assess the third-party service and its risks. Material commercial relationships will be disclosed where required by law.

You must not:

• Use ZASH for illegal activity
• Attempt to gain unauthorised access to the Service
• Interfere with servers, APIs, databases or security systems
• Scrape, copy or extract data at scale without permission
• Reverse engineer or attempt to reproduce the Service
• Circumvent payment, subscription or usage restrictions
• Distribute malware or harmful code
• Use the Service to harass, deceive or impersonate others
• Resell alerts or account access without written permission
• Publish Premium content in a way that substitutes for a paid subscription
• Use ZASH branding in a misleading manner
• Claim to be affiliated with or authorised by ZASH without permission
• Use automated systems in a way that creates unreasonable load
• Exploit errors, vulnerabilities or unintended functionality

We may investigate suspected misuse and take reasonable protective action.

The Service, including its branding, logos, interface, software, alert formats, databases, designs, graphics, text and original content, is owned by or licensed to ZASH and is protected by applicable intellectual property laws.

Subject to these Terms, ZASH grants you a limited, personal, revocable, non-exclusive and non-transferable right to use the Service for your own lawful, non-commercial use. You may not copy, reproduce, republish, distribute, sell, licence, modify or create derivative services from ZASH content without prior written permission, except where applicable law expressly permits it. Cryptocurrency names, logos and third-party trademarks belong to their respective owners.

We may update, modify, suspend or discontinue parts of the Service for reasons including maintenance, security, legal or regulatory requirements, third-party service changes, product development, commercial considerations and technical limitations. We will take reasonable steps to minimise disruption but do not guarantee uninterrupted availability.

We may release experimental, beta or early-access features. Such features may contain errors and may be changed or withdrawn without notice.

We may suspend or terminate access where we reasonably believe that:

• These Terms have been breached
• Payment is overdue, reversed or fraudulent
• An account creates security or legal risk
• The Service is being abused
• Fraudulent or misleading information was supplied
• Continued access could harm ZASH, users or third parties
• Suspension is required by law or a competent authority

Where appropriate, we may provide notice and an opportunity to remedy the issue. You may stop using the Service at any time. Stopping use does not automatically cancel a paid subscription. Sections that by their nature should continue after termination will remain in effect, including provisions concerning payments, intellectual property, disclaimers, liability and disputes.

The Service is provided on an "as available" basis. To the maximum extent permitted by law, we do not guarantee that the Service will:

• Always be available
• Be uninterrupted or error-free
• Meet every user's requirements
• Detect every relevant market event
• Generate a particular number of alerts
• Produce profitable results
• Be compatible with every device or third-party platform
• Be free from all security vulnerabilities

Nothing in these Terms excludes warranties or consumer protections that cannot lawfully be excluded.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of statutory rights that cannot be excluded, or any other liability that cannot legally be limited.

Subject to the above, ZASH is not responsible for losses arising from:

• Trading or investment decisions
• Changes in cryptocurrency prices
• Use of leverage
• Liquidations
• Missed or delayed alerts
• Incorrect or incomplete market data
• Exchange or blockchain failures
• Third-party service failures
• Unauthorised access caused by the user's failure to secure an account
• Loss of anticipated profits
• Loss of trading opportunities
• Indirect or consequential losses

For consumers, this limitation applies only to the extent permitted by applicable consumer law. For business users, to the maximum extent permitted by law, ZASH's total aggregate liability arising from the Service will not exceed the greater of: (1) the amount paid by the business user to ZASH during the three months immediately preceding the event giving rise to the claim; or (2) £100. The above business liability cap does not apply to liability that cannot legally be limited.

Our collection and use of personal information are described in the ZASH Privacy Policy. By using the Service, you acknowledge that personal information may be processed as described in that policy. The Privacy Policy should be reviewed together with these Terms.

You agree that we may send service-related communications electronically, including through email, Telegram, the ZASH website, account notifications and other contact methods you provide. Service-related communications may include payment confirmations, security alerts, subscription information, changes to the Service and updates to these Terms.

Marketing communications will be sent only where permitted by applicable law. You may unsubscribe from marketing communications, but you may still receive essential service messages.

We may update these Terms to reflect changes to the Service, changes in law or regulation, security requirements, new features, changes to payment arrangements or changes to our business operations. The updated version will be published with a revised "Last updated" date.

Where a change materially affects your rights or an active paid subscription, we will provide reasonable notice where required or reasonably practicable. Continued use after the effective date of an update constitutes acceptance of the revised Terms, except where applicable law requires additional consent.

You may not transfer your rights or obligations under these Terms without our written permission. We may transfer our rights and obligations to another organisation as part of a business transfer, restructuring, merger, acquisition or sale, provided that your rights are not materially reduced contrary to applicable law.

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue in effect. The affected provision will be interpreted or modified only to the minimum extent necessary to make it enforceable where legally possible.

If we do not immediately enforce a provision of these Terms, this does not mean that we waive our right to enforce it later.

These Terms, together with the Privacy Policy, applicable checkout information and any additional terms expressly accepted by you, form the agreement between you and ZASH concerning the Service.

These Terms are governed by the laws of England and Wales. If you are a consumer, you may also benefit from mandatory protections under the laws of the country in which you normally reside. Consumers may bring legal proceedings in any court permitted under applicable consumer law. Business users agree that the courts of England and Wales will have exclusive jurisdiction over disputes arising from these Terms or the Service.

Before beginning formal proceedings, the parties should attempt to resolve the dispute by contacting Support@zash.xyz.
